Part of the claims team preparing Prolongation Studies for each of the 50 trade contracts on behalf of the Client under bespoke developers’ contract. The studies consisted of assessing the critical path, delay, its causation, culpability, and entitlement to EoT.
Distressed Medium Sized West London Property Developer
Engaged as commercial director to head up and manage a team to stabilise the business after being significantly impacted by a combination of the pandemic, inflation and stagnant sales. Primarily involved with resolving high-value disputes with the supply chain and Housing Association clients under multiple fixed-price JCT and NEC based contracts.
This involved complex negotiations to increase a fixed price contract by £2.5m, the preparation of a successful £370k adjudication, the defence of a £200k subcontract adjudication and the preparation of a £4m claim including changes, EOT and defence against damages.
DE Group UK, Various Projects
Commercial Director managing a team of QSs and buyers. Primarily involved with providing contract reviews and negotiation of terms on a number of significant main and subcontract packages under NEC and JCT forms of contract, including negotiation and settlement of the contract sums.
Doosan Keltbray Consortium, Bradwell Power Station Decommissioning
Working for a consortium contracted to Magnox Ltd for the decommission and demolition of various parts of the former Bradwell Nuclear Power Station, including a £5m decommissioning of the Boiler Houses and £10m removal of the charge machines from the Main Reactor building out under NEC3 Option A and Option D forms of contract. Works included the preparation and negotiation of various CEs with complex and exhaustive supporting backup.
Ayrshire County Council
Working through a consultancy to clear of back log of issues caused by an underperforming fixed term Facilities Management Company. Including procurement of additional and realignment of existing supply chain contractors to achieve performance targets and KPI’s as required by the Local Authority. Works outstanding were over £10M reduced to less than £1M over a six-month period.
Westfield Stratford
Advising a major Construction Logistics Company on a very complicated and detailed bespoke contract wording which was exceptionally onerous and one sided. Though careful negotiation with a tricky developer the impact of the contract was reduced to a manageable level.
