CASE STUDY
Cambridge South Station – Network Rail Infrastructure Ltd
NRIL is in contract with J Murphy & Sons Ltd (JMS) for the construction of a new station at Cambridge South. The form of contract is a heavily amended NEC3 Option C let under an over-arching Framework Agreement. Detailed (Form B) Contractor’s Design, carried out by JMS under a separate design contract (also let under the Framework Agreement), has been absorbed within the construction contract. The works are on-going, with a target cost of circa £90m.
Significant claims have been raised by JMS under notified compensation events, not least of which relate to the process of developing the Form B designs to Approved for Construction (AFC) status, which requires approval of the designs by NRIL. JMS claim additional time and cost as a result of apparent changes from Form B to AFC, along with further time and cost resulting from the time taken by NRIL to provide such approvals.
MWCS are appointed by NRIL to scrutinise and provide defence against such claims by JMS. The matter involves 3 of the key members of staff included in this profile and is on-going.
